Unreasonable expectations about the nature and character of scientific knowledge support the widespread political assumption that predictive scientific assessments are a necessary precursor to environmental decision making. All too often, the practical outcome of this assumption is that scientific uncertainty becomes a ready-made dodge for what is in reality just a difficult political decision. Interdisciplinary assessments necessary to address complex environmental policy issues invariably result in findings that are inherently contestable, especially when applied in the unrestrained realm of partisan (...) politics. In this article, the authors argue that predictive scientific assessments are inherently limited in the extent to which they can guide policy development and that rigorous scientific assessments can be much more valuable in the role of ex post policy evaluation than they can in the context of ex ante policy formulation. Kane provides Self-Forming Actions as a rebuttal to allegations that indeterministic choices are determined by luck and are therefore not free. This paper explicates Kane’s proposal and provides a conceptual complication for Kane’s SFAs. The quantum events in an indeterministic world can be recreated in a deterministic world by pseudorandom number generation. This deterministic world is indistinguishable from the indeterministic world it simulates at the quantum, neurological, and phenomenological levels. Thus, indeterministic quantum behavior cannot secure free will in Kane’s SFAs (...) in any way which is not reproducible in a deterministic world. The paper addresses the objections that the proposed problem is merely an epistemic rather than metaphysical one and that a deterministic agent does not have plural voluntary control. I conjecture that a dualistic account of libertarian free will may dodge the problems I raise regarding Kane’s SFAs. (shrink)

Francis Bacon’s method of induction is often understood as a form of eliminative induction. The idea, on this interpretation, is to list the possible formal causes of a phenomenon and, by reference to a copious and reliable natural history, to falsify all of them but one. Whatever remains must be the formal cause. Bacon’s crucial instances are often seen as the crowning example of this method. In this article, I argue that this interpretation of crucial instances is mistaken, and it (...) has caused us to lose sight of why Bacon assigns crucial instances a special role in his quest for epistemic certainty about formal causes. If crucial instances are interpreted eliminatively, then they are subject to the two problems related to underdetermination raised by Duhem: (1) that it is impossible to be certain one has specified all of the possible alternatives and (2) that an experiment falsifies a whole theory, not just a single hypothesis in isolation. I show that Bacon anticipates and aims to dodge both of these problems by conceiving of crucial instances as working, in the ideal case, through direct affirmations that are supported by links to more foundational knowledge. "Not another book on Zhuangzi!"As it turns out, Wandering at Ease in the Zhuangzi, edited by Roger T. Ames, was found to be (...) not just "another book on Zhuangzi" but, instead, a wonderful collection of creative essays that genuinely wanders on Zhuangzi's vast spirit and that should appeal to a broad academic audience. Do not be deceived by the publisher's blurb on the back cover: "an excellent balance of philological and philosophical analysis." This summary of the book's contents proves to be fortunately misleading.The common thread running through this book is that it is dedicated to Yang Yu-wei, who taught many of the contributors while they were graduate students at Taiwan Normal University. Randall P. Peerenboom hilariously describes his first encounter with Professor Yang in a coda to his essay "Living Beyond the Bounds:Henry Miller and the Quest for Daoist Realization":He darted across the busy main street, dodging traffic, all the while calling out my name in a booming voice sure to attract the attention of the wandering undead and waving his arms in whirlwind fashion, managing somehow to evoke simultaneously images of Don Quixote and Sancho Panza, Jack Nicholson in One Flew over the Cuckoo's Nest, and the Bodhidharma. Welcome, I thought, to the wonderful world of Oz.(p. 139) [End Page 125]This description sets the tone for the essays here, which concentrate on the Zhuangzi's humor, character, and personality, unafraid to stride out across the busy, one-way streets of traditional academic disciplines. While remaining rigorously within the bounds of academic probity, this volume steadfastly resists the dangerous encroachment of desiccating intellectualism upon the wit, intelligence, and charm of one of the world's greatest works of literature.All of the essays "live beyond the bounds" in some fashion or other. Chris Jochim's "Just Say No to 'No Self' in Zhuangzi" reviews recent writing on self and personhood in the Zhuangzi, and includes the treatment of Zhuangzi in the theories of flow and happiness by the noted psychologist Mihalyi Csikszentmihalyi. Daniel Coyle's study of the zhenren (authentic person), lurks tentatively in the shadows of comparative mysticism. A comparison such as "Theocentrism aside, Zhuangzi's language is Eckhart-like in that it cancels itself out, short-circuiting the intellect so as to open one up to spontaneity and the omnipresence of Heaven" deserves greater exploration than a short essay can afford. James D. Sellmann's essay on the transformative effects of humor is briefly illuminated by a reference to Milan Kundera's The Book of Laughter and Forgetting (1986),1 but this worthy literary intersection is only pursued in a footnote. The question of philosophy and literature is also raised in William Callahan's study of action and decision making in the story of Cook Ding. Callahan, again in footnotes, acknowledges the influence of Kundera, Barthes, and Derrida in his quest to understand what it means to "read" literary philosophy or philosophical literature. His essay, however, owes its chief debt to the linguistic analysis of Chad Hansen and A. C. Graham, and we can only hope that he will soon furnish us with the full fruits of his literary education.One group of essays deals with particular characters in the Zhuangzi. Kirill Ole Thompson's inventive study of fishermen in the Zhuangzi wades into the waters of Tang poetry, incorporating translations of Zhang Zhihe, Liu Zongyuan, Wang Wei, and Sikong Shu. The literary connection is only in a coda, but it is there nonetheless. A future study would perhaps do well to broaden this research to include works of art. One thinks of Wang Meng's masterpiece of around 1360, Fisherman of Huaxi or the Yuan literatus Wu Zhen's Fisherman Recluse on Lake Dongting, both in the collection of the National Palace Museum, T'aipei.2Zhuangzi's close companion, Hui Shi, is the subject of... Thomas Schelling, who wrote the foreword for this book, won the Nobel Prize in economics for "having enhanced our understanding of conflict and cooperation through game-theory analysis." This came after he had taught a course in game theory and rational choice to advanced students and government officials for 45 years. In this book, Robert Dodge provides in language for a broad audience, the concepts that Schelling taught. Armed with Schelling's understanding of game theory methods and his approaches to problems, (...) the general reader can improve daily decision making. Mathematics often make game theory challenging but was not a major part of Schelling's course and is even less of a factor in this book. Along with a summary of the material Schelling presented, included are problems from the course and similar less challenging questions. While considerable analysis is done with the basic game theory tool--the two-by-two matrix--much of the book is descriptive and rational decision-making is explained with stories. Chapter supplements are added to illuminate points presented by Schelling, including writings by Paul Krugman, Thomas Friedman, Steven Levitt, and others. (shrink)

Approximately one in 10 children in foster care are medically complex and require intensive medical supervision, frequent hospitalization, and difficult medical decision making. Some of these children are in foster care because their parents cannot care for their medical needs; other parents are responsible for their child’s medical needs due to abuse or neglect. In either case, there can be uncertainty about the role that a child’s biological parents should play in making serious medical decisions. Here we highlight some of (...) the ethical challenges inherent in making these decisions for children in foster care, as seen through the lenses of a child welfare provider, an inpatient care physician, and a primary care pediatrician. The paper by Susan M. Wolf and Jeffrey P. Kahn published in this issue of the Journal of Law, Medicine & Ethics notes that we are members of the Working Group on Genetic Testing in Disability Insurance and that the members of the Working Group do not necessarily subscribe to its recommendations. Although we agree with some of Wolf and Kahn's recommendations, we do not agree with recommendations 1, 3, 4, and 5 for individual disability insurance and recommendations 1, 2, (...) and 3 for group disability insurance. We use this paper to delineate our areas of disagreement, but we do not discuss areas such as employment law as they are not our areas of expertise.First, understanding our roles on the Working Group is important. As members, we provided technical expertise on disability insurance. Our input to the Working Group represents our individual opinions. (shrink)

While the low conviction rate for cases of sexual violence is often justified by the so-called ‘he-said-she-said’ nature of these cases, the increasing presence of digital evidence has begun to challenge this justification. This digital evidence can provide new opportunities for intervening in and prosecuting sexual violence. However, it may also be used against complainants or deemed still insufficient for proving guilt. Thus, while digital evidence may be challenging typical criminal justice responses to sexual violence, it may equally be utilised (...) to buttress entrenched stereotypes and criminal justice practices that lead to complainant dissatisfaction and serve to support low conviction rates. I draw on critical feminist legal theory, feminist engagements with digital technology and sexual violence, and visual criminology to theorise the burgeoning role of the digital witness in sexual violence cases. Media, police, and educational responses to nonconsensual pornography (i.e. ‘revenge porn’) have been critiqued for relying on sex negative beliefs that result in victims of this act being blamed and shamed for their own victimisation. In this article I analyse judicial discourse in nonconsensual pornography case law to assess the extent to which sex negativity is embedded in legal responses. I find that, while overt victim blaming and shaming is not present in the judicial discourse, subtle forms of sex negativity (...) are expressed in a minority of cases through references to consensual youth image sharing as inappropriate and through the framing of reputational harms. I argue that it is essential for legal responses to not only avoid sex negative narratives (as most currently do) but to actively reveal and counter the sex negative beliefs that underlie many of the harms associated with nonconsensual pornography. The primary psychological process leading aggressive children to grow into dysfunctional adults is a defensive mindset, which encompasses a pattern of deviant social information processing steps, including hypervigilance to threat; hostile attributional biases; psychophysiological reactivity, experience of rage and testosterone release (in males); aggressive problem-solving styles; aggressogenic decision-making biases; and deficient behavioral skills. These processes are acquired in childhood and predict adult maladjustment outcomes, including incarceration and premature death. The antecedents of defensive mindset lie in early childhood experiences of trauma (...) and threat. The Fast Track (FT) intervention was designed to improve social competence in aggressive children. A randomized controlled trial demonstrated that FT is effective in preventing externalizing psychopathology; the primary mediating factor is the reduction of defensive mindset processes. This Element concludes with insights that defensive mindset might also explain dysfunction in other realms, including school culture, parenting, marriage, the workplace, intergroup relationships, politics, and international relations.
